Terms of Service

These Terms of Service ("Terms") govern your use of the RAiDAR mobile application ("App") operated by RAIDAR LABS LLC ("RAiDAR Labs," "we," "our," or "us"). By downloading, installing, or using the App, you agree to these Terms.

1. Use of the App

RAiDAR is a sports technology tool that uses your iPhone's camera and on-device machine learning to estimate baseball pitch velocity. You may use the App for personal, non-commercial purposes in accordance with these Terms.

You agree to:

• Use the App only for lawful purposes
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App in any way that could damage, disable, or impair its functionality
• Comply with all applicable laws and regulations when using the App

2. Accuracy Disclaimer

RAiDAR provides estimated pitch velocity measurements using computer vision and machine learning. While we strive for accuracy, these measurements are approximations and should not be treated as exact or equivalent to professional radar gun readings.

Velocity readings may vary based on factors including but not limited to:

• Camera angle and distance from the pitcher
• Lighting conditions
• Video stability
• Device model and capabilities

Do not rely on RAiDAR measurements for professional scouting, medical decisions, or any context where precise velocity data is critical.

3. Ownership

The App, including its design, code, machine learning models, algorithms, graphics, and content, is owned by RAIDAR LABS LLC. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes. You may not copy, modify, distribute, or create derivative works based on the App.

4. Subscriptions and Payments

Access to the full RAiDAR App is provided through an auto-renewing subscription distributed through the Apple App Store.

Subscription details:

• Product: RAiDAR Pro — full access to all App features
• Price: $19.99 USD per year (pricing may vary by region and is shown in your local currency at purchase)
• Free trial: New subscribers receive a 7-day free trial. You will not be charged during the trial, and you may cancel at any time before it ends to avoid being charged.
• Family Sharing: Supported. One subscription may be shared with up to five family members through Apple Family Sharing.

Auto-renewal: Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless they are canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price, unless the price has changed and you have been notified in advance. You can manage and cancel your subscription at any time by going to your Apple ID account settings on your device after purchase.

Cancellation: To cancel, open the Settings app on your iPhone, tap your name, tap Subscriptions, select RAiDAR, and tap Cancel Subscription. Cancellation takes effect at the end of the current billing period; you retain access until then.

Refunds: All purchases are processed by Apple. Refund requests are handled by Apple in accordance with its refund policy. RAiDAR Labs does not directly process refunds.

Promo and offer codes: From time to time we may distribute promo or offer codes that grant access to RAiDAR Pro at no cost or at a discount. Codes are non-transferable, cannot be redeemed for cash, and may expire. Redeeming a code does not change the auto-renewal terms that apply after the promotional period ends, unless stated otherwise at the time of redemption.

Price changes: We may change subscription prices from time to time. Any price change will be communicated to you in advance in accordance with Apple's requirements, and your continued subscription after the change constitutes acceptance of the new price.

5. Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we handle data. In summary: all video and pitch data stays on your device. We do not collect personal information.

6. User Content

All videos recorded and data generated through the App remain your property. RAiDAR does not claim any ownership over content you create using the App. Since all data is stored locally on your device, you are responsible for backing up any content you wish to preserve.

7. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, or error-free
• Velocity measurements will be accurate in all conditions
• Any defects in the App will be corrected

8. Limitation of Liability

To the maximum extent permitted by applicable law, RAiDAR Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

9. Assumption of Risk

Baseball activities involve inherent risks of physical injury. RAiDAR is a measurement tool and does not replace proper safety practices. You assume all risks associated with baseball activities conducted while using the App.

10. Modifications to the App and Terms

We reserve the right to modify or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
